Align Technology Inc, San Jose, Calif, has sued ClearCorrect LLC, Houston, for patent infringement and for selling its transparent orthodontic aligners at too low a cost, according to an article the Houston Business Journal. In February 2009, ClearCorrect sued Align, claiming Align’s patents were invalid. That case was dismissed 2 months later.

Align filed the most recent lawsuit in the US District Court for the Southern District of Texas, Houston Division.

Align claims it has suffered and continues to suffer losses and damages as a result of ClearCorrect’s selling its products below manufacturing costs.
